Release of Liability

I, the undersigned, for myself and on behalf of my child or legal ward named below, do hereby voluntarily request to participate in farm-based activities sponsored by Christina Sapien-Iezzi and Michael Iezzi. For purposes of this statement, the person actually participating in farm-based
activities is referred to as “participant.” Farm-based activities include, but are not limited to (1) walking around the property (located at 10611 Rougemont Rd. Bahama, NC 27503 and 10615 Rougemont Rd. Bahama, NC 27503), (2) cutting and collecting herbs and flowers, (3) interacting with the space such as any animals, playground equipment, swing, trampoline, swimming pool, and other equipment on the premises.
Disclosure and Agreements
1. The undersigned understands that there are inherent and unavoidable risks when interacting with nature. Nature can be unpredictable in regard to its inhabitants, the land, and the weather. The undersigned voluntarily assumes all these risks and dangers.
2. The undersigned agrees to abide by the rules and regulations set forth by camp owners and facilitators.
3. The undersigned understands that there are certain dangers or conditions that are an integral part of an agritourism activity including certain hazards, including surface and subsurface conditions, natural conditions of land, vegetation, and waters, the behavior of wild or domestic animals, and ordinary dangers of structures or equipment ordinarily used in farming and ranching operations. Inherent risks of agritourism activity also include the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, including failing to follow instructions given by the agritourism professional or failing to exercise reasonable caution while engaging in the agritourism activity.
Release from Liability; Waiver of Right to Sue

The undersigned agrees that, except for any intentional injuries caused by farm and property owners (Christina Sapien-Iezzi and Michael Iezzi), the participant waives his/her right to sue in any way, including its owner, directors, agents, managers, instructors and employees, whether paid or volunteer, in an account of any personal injury, death, or property damage suffered or sustained in connection with the participants engaging in farm related activities at 10611 Rougemont Rd. Bahama, NC 27503.

 

WARNING Under North Carolina law, there is no liability for an injury to or death of a participant in an agritourism activity conducted at this agritourism location if such injury or death results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agritourism activity.

Release of Liability

I, the undersigned, for myself and on behalf of my child or legal ward named below, do hereby voluntarily request to participate in equine activities sponsored by Fonteyn Farms LLC (referred to as “Fonteyn Farms”). Fonteyn Farms shall also include Jaclyn McVey. For purposes of this statement, the person actually participating in the equine activities is referred to as “participant”. 

Equine activities include, but are not limited to (1) equine shows, fairs, competitions, performances or parades that include any or all breeds of equines (i.e. horses, ponies, mules, donkeys or hinnies) and any of the equine disciplines, including but not limited to dressage, hunter and jumper horse shows, grand prix jumping, three day eventing, horse trials, combined training, rodeos, driving, pulling, cutting, steeplechasing, endurance trail riding, gymkhanas, western games and hunting; (2) equine care to include, but not to be limited to catching, leading, grooming and equine teaching activities; (3) boarding equines; (4) riding, inspecting or evaluating an equine belonging to another whether the owner has received some monetary consideration or other thing of value for the use of the equine; and (5) rides, trips, hunts or other equine activities or any type however informal or impromptu that are sponsored by Fonteyn Farms. 

Disclosures and Agreements

 1. The undersigned understands that equine activities involve inherent and unavoidable risks, including the propensity of a horse to behave in a dangerous way which may result in injury or death to the participant and the inability to predict a horse’s reaction to sound, movements, objects, persons or animals, and hazards to surface and subsurface conditions. The undersigned voluntarily assumes all these risks and dangers.

 2. The undersigned further understands that when dealing with the horse, the participant is the primary control of the horse and agrees that Fonteyn Farms, is not responsible for the results of the participant’s actions or inactions. The participant also agrees not to abuse or deliberately aggravate the horse as these actions may result in an increased risk to the participant and others. 

3. The participant has been advised to purchase and wear a helmet or hard hat while engaging in equine activities to avoid any horse related injuries. 

4. The participant agrees to abide by all rules and regulations set for the equine activities established by Fonteyn Farms, from time to time. 

5. The participant understands that Fonteyn Farms is not in control of external factors such as other people, horses, animals, or the lay of the land on any farm where lessons, training, horse showing, or other equine activities and that these present possible 

Release from Liability; Waiver of Right to Sue 

The undersigned agrees that, except for any intentional injuries caused by Fonteyn Farms LLC, the participant waives his/her right to sue Fonteyn Farms LLC, in any way, including its owner, directors, agents, managers, instructors and employees, whether paid or volunteer, in an account of any personal injury, death, or property damage suffered or sustained in connection with the participants engaging in equine activities sponsored by Fonteyn Farms LLC. The agreements, releases and waiver set forth in the preceding paragraph shall also apply to and protect Tonya and Justin Miller (lessors of the premises of Fonteyn Farms) and their family including Hunter Miller and Christina Sapien-Iezzi and Michael Iezzi (sponsors of Fonteyn Farms).

 

WARNING: Under North Carolina law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting exclusively from the inherent risks of equine activities. Chapter 99E of the North Carolina statutes.
